Copyright and the Digital Millennium Copyright Act

Marco Island Cable (MIC) acknowledges and respects the intellectual property rights of others and we are committed to complying with U.S. copyright laws. The Digital Millennium Copyright Act of 1998 ("DMCA") provides legal protection for owners of copyrighted material who believe that their rights under U.S. copyright law have been infringed via the Internet. As an online service provider, our policy is to act and respond to all notices of alleged infringement that comply with the Digital Millennium Copyright Act.

 

 

User Obligations

 

It is expected that all users of any part of the MIC communication system will comply with applicable copyright laws. However, if MIC is notified of claimed copyright infringement, or otherwise becomes aware of facts and circumstances from which infringement is apparent, MIC will comply with the “notice and takedown” procedures set forth in the Digital Millennium Copyright Act (17 U.S.C. § 512).  This may include expeditiously removing, or disabling access to, the material that is claimed to be infringing or to be the subject of infringing activity. If time permits, MIC may, in its sole discretion, give an alleged infringer a reasonable opportunity to remove the infringing material itself.

 

In addition, it is MIC’s policy in accordance with the DMCA and other applicable laws to reserve the right to terminate the Service provided to any customer or user who is either found to infringe third party copyright or other intellectual property rights, particularly including repeat infringers.  In such case MIC may terminate the Service at any time with or without notice for any affected customer or user.

 

If a copyright infringement notice has been wrongly filed against you as a result of mistake or a misidentification of the material, you may file a counter notification with our Designated Agent (identified below). The counter notification must provide the following information:

1.         Physical or electronic signature of the subscriber;

2.         Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled;

3.         A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification;

4.         The subscriber’s name, address, telephone number and email address, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the subscriber's address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification or an agent of such person.

 

 

 

Notification Of Claimed Copyright Infringement

 

If you determine that your work has been duplicated and is either accessible from a website that you believe is being hosted on servers of MIC, or published in a manner attributable to an IP address distributed by MIC, please give notice to our Designated Agent as prescribed by the DMCA. The notice must include particular information as provided by the Digital Millennium Copyright Act, 17 U.S.C. 512 ( c ) (3).
